Are Fake California Republican Ballot Boxes Legal? – FindLaw

I previously wrote this blog about the anger surrounding dropbox. Several states are deploying them to assuage voters’ concerns about the inefficiency of the U.S. Postal Service by mailing ballot papers on time.

But the Trump campaign and several elected Republican officials are arguing Dropped boxes are magnet for voter fraud. Without constant monitoring, they say, voters can stuff the ballot boxes or simply dispose of the ballots already deposited.

But Drop Box Wars has now entered a new phase.

California Republican Party says what’s good for goose …

In California, where the state has ballot boxes spread across the state, people are starting to notice some extra boxes appearing elsewhere. The boxes look similar to official drop boxes, in fact, they have signs that read “official ballot box” or “ballot box”.

It turns out that The California Republican Party is behind the mystery boxesIt is not official by anything. But it can be legal.

To date, the party has placed more than 50 boxes near gun stores, churches, and party offices in Los Angeles, Fresno and Orange counties. While President Trump is not expected to lead the state in the presidential election, this part of California is home to several hugely contested congressional elections, and the funds could boost Republican voter turnout.

Ballot harvesting is legal in California

California Secretary of State Alex Padilla and Attorney General Xavier Becera, both Democrats, have sent cease and desist letters to the party, warning that they are breaking the law.

But the state’s Republican Party is defiant, with a spokesman for Hector Barajas saying they will put more funds across the state, with “official” tags on them.

Barajas and the party argue that California’s so-called “ballot harvesting” law permits the use of ballot boxes, and that the party simply makes it easier for voters to return their ballot papers. Law 2016 Eliminates the requirement that only a spouse, family member, or roommate can return someone else’s ballot by mail.

“The way the Democrats wrote the law, if we wanted to use a Santa bag, we could. A sealed heavy box looks much safer,” Barajas said.

Padilla and Becera do not accuse Republican officials of “selective harvesting,” or of going to the ballot papers returned in their boxes and throwing away the ones they suspect belong to the Democratic candidates. Padilla argues, though, that The funds are not covered by any laws, And they “mislead the audience.”

Even though the elections were less than three weeks ago, this issue is likely not over yet. Other California groups are likely to try this tactic in future elections, and courts or lawmakers may need to take their opinion.

What should you do?

If you live in California Maintains online poll tracking software You can use it to check that the ballot is delivered and counted. This is important if you believe you put the ballot in one of these bogus “official” ballots. Many other states are using programs like this now due to the massive increase in mail ballots in these elections.
